Short-Term Rental Agreement

1. PROPERTY ADDRESS

4481C Luke Ave, Destin, FL 32541 (“Premises”)

2. RENTAL TERM

  • Check-in: {{checkin_date}} at {{checkin_time}}
  • Check-out: {{checkout_date}} at {{checkout_time}}

Early check-in or late check-out must be pre-approved in writing. Unauthorized late checkouts will be charged $100/hour.


3. QUIET HOURS

Per Destin City Noise Ordinance, quiet hours are 10:00 PM to sunrise. During this time:

  • No outdoor lights or music
  • Keep noise levels to a minimum out of respect for neighbors

4. OCCUPANTS

  • Maximum number of guests: {{number_of_guests}}
  • Guest must be 25 years or older to book
  • Valid government-issued ID may be requested prior to check-in
  • No unregistered guests or day visitors without written approval
  • Any misrepresentation or unauthorized occupants may result in eviction without refund

5. NO SUBLETTING OR THIRD-PARTY BOOKINGS

  • No subletting or reservation transfers allowed
  • No third-party bookings permitted
  • The booking guest must be present during the stay
  • Unauthorized occupancy may lead to eviction and forfeiture of all monies paid

6. SECURITY DEPOSIT & DAMAGE

A $200 hold may be placed on the guest’s card before arrival. Guest is financially responsible for:

  • Lost remotes ($200 each)
  • Excessive cleaning needs (with photo evidence)
  • Missing/damaged items or property
  • Reimbursement for discounts/refunds to future guests due to violations

7. CANCELLATIONS

Guest agrees to the cancellation policy outlined by the booking platform. For stays over 30 days, a lease and background check may be required.


8. PROPERTY USE POLICY

  • No parties, events, or gatherings
  • No unregistered, outside, or day guests without approval
  • Any third-party vendors (e.g., photographers, caterers) require prior written approval
  • Commercial use is strictly prohibited, including but not limited to:
    • Activities generating revenue
    • Advertising or brand promotions
    • Content creation for influencer or marketing use
    • Hosting clients, classes, or business meetings
  • Unauthorized commercial use may result in eviction and legal liability

9. PET POLICY

  • No pets permitted
  • Presence of pets may result in eviction, deposit loss, and no refund

10. NO SMOKING, VAPING, OR FIRE

Prohibited anywhere on the property:

  • Cigarettes, cigars, vape pens, marijuana (medical or recreational)
  • Candles, incense, fire pits, grills brought by guests, or open flames

Violations result in $500 fine and possible eviction.


11. PARKING & DRIVEWAY

  • Max 2 vehicles allowed on-site
  • Driveway is shared with a full-time resident neighbor
  • Park only on the right side
  • Do NOT park on the neighbor’s gravel area, marked with planters
  • Tampering with barriers or driving on restricted areas may result in damage liability
  • Unauthorized vehicles, RVs, trailers require prior written approval
  • Violations may result in daily fines or towing at guest’s expense

12. POOL USAGE & ALARM

  • No lifeguard on duty – swim at your own risk
  • Pool hours: 7:00 AM to 10:00 PM
  • Rinse off sand before pool or home entry

By using the pool, Guest agrees to:

  • Waive claims against the Owner
  • Accept responsibility for all users
  • Use safety precautions at all times

Pool Alarm Notice: To comply with Florida law, alarms on all pool-access doors will sound if opened without pressing the disarm button. This system helps protect children and non-swimmers but is not a substitute for supervision.


13. PROPERTY CARE & CLEANING

Guests agree to:

  • Rinse off sand before entering home/pool
  • Return beach chairs & umbrellas to storage daily
  • Dispose of fish debris off-site (trash bag fines: $50)
  • Report cleanliness concerns within 2 hours of arrival
  • Flush only toilet paper
  • Maintain general cleanliness; excessive mess may result in fees

14. HOUSE AMENITIES & ITEMS

  • No daily housekeeping service provided
  • Do not remove towels/linens from the property
  • Lost/damaged remotes charged at $200 each
  • Provided amenities include:
    • EV charger
    • Arcade
    • Roku TVs
    • Washer/dryer
    • Kitchen appliances
    • Beach gear (chairs, umbrellas, wagon)
  • Do not leave beach equipment at the beach overnight

15. EQUIPMENT USE & RESPONSIBILITY

Items (e.g., beach chairs, umbrellas, wagons) are provided as-is:

  • Not regularly inspected for safety
  • Guest uses at their own risk
  • Owner not liable for injuries or failures (e.g., collapsing chairs, tipping wagons)

Guest responsibilities:

  • Return items to storage daily
  • Maintain reasonable condition
  • Report damaged or unsafe items promptly
  • Failure to report may result in liability for issues caused

16. SAFETY DEVICES

Tampering with or disabling any safety device (e.g., pool alarms, smoke detectors, security camera) is strictly prohibited and may result in eviction and fines.


17. RIGHT OF ENTRY

Owner/agents may enter for emergencies, repairs, or inspections with reasonable notice. Service vendors (pool, lawn, trash) may access exterior areas without notice.


18. LIABILITY & INDEMNIFICATION

Guest agrees to hold Owner harmless for:

  • Injury, illness, or death on or near the property
  • Loss or damage to personal property
  • Any breach of this agreement

19. WEATHER & FORCE MAJEURE

  • No refunds for weather unless a mandatory evacuation is ordered for Okaloosa County
  • Refunds apply only to unused nights or upcoming arrivals during such orders
  • Shortened stays after warnings are lifted are not refundable
  • No refunds for voluntary cancellations or discomfort

Guests are encouraged to purchase travel insurance. If covered, the Guest must file a claim directly. Owner is not obligated to refund if insurance is available.


20. ENFORCEMENT & BREACH

Violations may result in:

  • Immediate eviction without refund
  • Loss of security deposit
  • Legal action for damages

Guest agrees not to interfere with platform processes, dispute systems, or retaliate via reviews due to enforcement of this Agreement.


21. GOVERNING LAW

This Agreement is governed by Florida law. Venue shall be Okaloosa County.


22. COMPLIANCE WITH LOCAL LAWS

Guest must comply with all federal, state, and local laws—including City of Destin short-term rental regulations.


23. ENTIRE AGREEMENT

This document, along with any Crystal Haven Digital Guide and applicable OTA booking terms (Airbnb, VRBO, etc.), represents the full agreement. In case of conflict, this document shall prevail


NOTE FOR AIRBNB GUESTS: Due to Airbnb’s policy, we do not require a separate signature. By confirming your booking, you acknowledge that you’ve received, reviewed, and agree to the above terms. A copy of this Agreement is available upon request or at .
